These Terms of Service ("Terms") govern your access to and use of BandForm and any other services provided by Neutronics ("we," "us," "our"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.
1. What BandForm Is
BandForm is a browser-based tool for viewing and analyzing electroencephalography (EEG) recordings stored in the European Data Format (EDF/EDF+). It computes signal-processing outputs including power spectral density, frequency band power, spectrograms, cross-channel correlation, channel quality indicators, amplitude-based artifact flags, and derived scalar features, and allows export of these values as CSV.
2. Not a Medical Device — Research and Educational Use Only
BandForm is provided for educational and research purposes only.
BandForm is not a medical device. It is not intended for, and must not be used for, the diagnosis, treatment, cure, mitigation, or prevention of any disease or medical condition. It has not been reviewed, cleared, or approved by the U.S. Food and Drug Administration or any other regulatory authority.
Nothing produced by BandForm — including any chart, computed value, quality flag, or artifact annotation — constitutes medical advice or a clinical finding. Artifact flags indicate statistical properties of the signal, not clinical abnormality.
Do not use BandForm to make clinical decisions. Do not rely on it in any context where an error could affect a person's health or safety.
3. Your Data and Your Responsibility
This section is the most important part of these Terms. Please read it carefully.
3.1 De-identified data only
You may upload only de-identified recordings and metadata. You must not upload personally identifiable information about any individual, including but not limited to names, dates of birth, medical record numbers, contact details, or any other direct or indirect identifier.
Where BandForm asks for a "participant" label, use a coded identifier (for example, S01), not a person's name.
3.2 You must have the right to upload
By uploading any recording or data, you represent and warrant that:
- You have all necessary rights, permissions, consents, and approvals to upload it and to have it processed by BandForm;
- Where the data originates from human participants, you have obtained appropriate informed consent and, where applicable, approval from an institutional review board, research ethics committee, or equivalent body;
- Your use of the data complies with all laws, regulations, institutional policies, and data-use agreements that apply to you.
You are solely responsible for the data you upload. We do not review uploads and cannot verify their provenance or the adequacy of your consents.
3.3 Ownership
You retain all rights in the data you upload. We claim no ownership over it. We process it only to provide the service to you, as described in our Privacy Policy.
We do not use your uploaded recordings to train machine-learning models.
4. Accounts
You must provide accurate information when registering and keep your credentials confidential. You are responsible for all activity under your account. Notify us promptly at info@neutronicsai.com if you believe your account has been compromised.
You must be at least 18 years old, or the age of majority in your jurisdiction, to use BandForm.
5. Acceptable Use
You agree not to:
- Upload data you are not authorized to upload, or that contains identifiable personal information;
- Use BandForm for clinical, diagnostic, or treatment purposes;
- Attempt to access another user's account, data, or files;
- Probe, scan, or test the vulnerability of the service, or circumvent any authentication, rate limiting, or access control;
- Upload malicious files, or files crafted to disrupt or overload the service;
- Use automated means to access the service in a manner that imposes an unreasonable load;
- Reverse engineer, resell, or sublicense the service.
We may suspend or terminate accounts that violate these Terms.
6. Availability and Changes
BandForm is provided on an "as available" basis. It is early-stage software under active development. We may change, suspend, or discontinue any part of the service at any time, with or without notice.
We make no guarantee of uptime, and we may perform maintenance or deployments that interrupt access.
7. No Warranty — Including as to the Accuracy of Computed Values
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We make no warranty that:
- The service will be uninterrupted, secure, or error-free;
- Any value computed by BandForm is accurate, complete, or suitable for your purpose;
- Results are reproducible across versions of the software.
Signal-processing outputs depend on parameters including filter settings, frequency band boundaries, montage, and sampling rate. You are responsible for verifying that the parameters and outputs are appropriate for your analysis. Where BandForm records the parameters used to compute a result, you should confirm they match your intended configuration before relying on the numbers.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEUTRONICS AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR RESEARCH RESULTS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability is limited to the greatest extent permitted by law.
9. Data Loss
You are responsible for maintaining your own copies of any data you upload and any results you wish to keep. Do not use BandForm as your only copy of a recording. While we take reasonable measures to store data durably, we do not guarantee against loss.
10. Indemnification
You agree to indemnify and hold harmless Neutronics and its operators from any claim, demand, loss, or expense (including reasonable legal fees) arising from your use of the service, your data, or your breach of these Terms — including any claim that data you uploaded was uploaded without adequate rights or consent.
11. Termination
You may delete your account at any time from your account settings. We may suspend or terminate your access at any time, for any reason, including violation of these Terms.
On deletion, we will remove your account and associated data as described in our Privacy Policy.
12. Changes to These Terms
We may update these Terms. If we make material changes, we will take reasonable steps to notify you, such as by email or a notice in the service. Continued use after changes take effect constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws principles. Any dispute shall be brought in the state or federal courts located in Collin County, Texas, and you consent to their jurisdiction.
